Please read these Terms of Service carefully before using the Loxala platform. They govern your access to and use of our services.
1. Acceptance of Terms
By accessing or using Loxala, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use our platform. These terms apply to all visitors, users, and others who access or use the service.
2. Description of Service
Loxala is a marketplace that connects clients with freelancers. We provide tools for posting projects, submitting proposals, communicating, executing contracts, and processing payments. We are not a party to any agreement between clients and freelancers.
3. User Accounts
You must create an account to use certain features of the platform. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information when registering.
4. Fees and Payments
Loxala charges service fees on transactions completed through the platform. Fee schedules are available on our Pricing page and may be updated from time to time. All fees are non-refundable except where expressly stated. Payment processing is handled by third-party providers.
5. Prohibited Conduct
You agree not to use the platform to engage in fraud, circumvent our payment system, post false information, violate intellectual property rights, harass other users, or engage in any activity that violates applicable law. Violations may result in immediate account suspension.
6. Intellectual Property
Loxala retains all rights to its platform, brand, and technology. Content you submit remains yours, but you grant Loxala a license to use it to operate the service. You represent that you have the rights to any content you post.
7. Dispute Resolution
In the event of a dispute between a client and freelancer, Loxala may offer mediation services. Disputes not resolved through mediation will be subject to binding arbitration under the rules of the American Arbitration Association, in San Francisco, California.
8. Limitation of Liability
To the maximum extent permitted by law, Loxala shall not be liable for indirect, incidental, special, or consequential damages arising from your use of the platform. Our total liability shall not exceed the fees paid by you in the 12 months preceding the claim.
9. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by posting the new Terms on the platform and updating the 'last updated' date. Continued use of the platform after changes constitutes acceptance of the new Terms.
